Uninhabitable for more than three months

“During the 2011 flood, the undercover car parks at my investment property on Melbourne Street were flooded, not from Brisbane River but backflow from storm water drains owned and operated by the Council. An insurance claim for loss of rent was successful, however this policy type is no longer offered. The Body Corporate placed a special levy on lot owners to help pay for remediation costs until the claim was received. In 2022 the undercover car parks flooded again from storm water drain backflow. The Body Corporate took out a $325,000 strata loan to pay for remediation costs instead of the special levy. In both floods, the building was deemed uninhabitable for more than three months due to no power and the fire alarm system, but people still chose to live onsite.”
